Terms and conditions

Below you will find the applicable terms and conditions regarding registration, payment, cancellation, and deadlines for Continuing Education programmes at VIA University College (“VIA”).

The terms and conditions set out below apply to your registration. You are therefore encouraged to review them carefully to ensure that you are aware of your rights and obligations before registering for an activity.

The terms and conditions apply to courses and education held in and by VIA, which are collectively referred to as the "Activities".

1. Registration

1.1. Registration for an Activity is completed via VIA's website by following the designated registration link. During the registration process, you will be redirected to the application portal nemStudie. In nemStudie, you must authenticate using mitID to complete and submit your application. In the absence of a valid mitID, you may complete your registration in nemStudie by authenticating via your e-mail address.

1.2. Communication between you and VIA during the application period takes place via nemStudie. Upon completion of your digital registration, you will receive an automatic order confirmation by e-mail. This order confirmation only serves as a receipt for your registration.

1.3. The agreement for the purchase of an Activity is concluded between VIA and you. The agreement is binding from the time of registration; however, the agreement is conditional on VIA's final acceptance of the registration, including that you meet any admission requirements, that the Activity is established, and that there are available places at the Activity.

1.4. Once the registration has been processed by VIA, and it can be confirmed that you meet any admission requirements, that the Activity is established, and that there are available places at the Activity, your registration is finally accepted. You will receive an email from VIA with order confirmation of final acceptance of the registration. You will then be charged a participation fee, cf. section 2 below.

1.5. Should the Activity fail to be established or be cancelled, VIA reserves the right to withdraw from the agreement at any time. In such cases, any fee already paid will be refunded; however, no further claims may be raised against VIA in this regard.

2. Price

2.1. As a student/participant taking part in Activities, you must pay a participation fee. The participation fee covers the costs associated with teaching, guidance and three exam attempts. The participation fee does not cover expenses for learning materials, accommodation, meals or transportation.

Meals:

  • If meals and/or residential course accommodation are included as part of the Activity, these will be invoiced separately on the total invoice. Meals and residential course accommodation costs are subject to VAT.

2.2. VIA reserves the right to make price adjustments. Current prices can be found at any time on VIA's website. Teaching in courses offered under the Danish Open Education Act (Åben Uddannelse) is exempt from VAT. Tuition for courses offered as revenue-generating activities is subject to VAT.

3. Payment

3.1. The payment gives you the right to follow the Activity, including attending teaching sessions, receiving guidance and taking the exam during the period you have paid for.

3.2. The participant fee is invoiced after you have been admitted to the Activity. The deadline for timely payment is stated on the invoice.

3.3. VIA issues invoices as follows:

  • To public companies in Denmark:
    • As an electronic invoice to the EAN number provided by the customer/buyer.
  • To private companies in Denmark:
    • As Digital Post via www.virk.dk
    • Private companies in Denmark also have the option of having an invoice sent via EAN number.
    • Exceptionally via e-mail
  • To private individuals in Denmark:
    • As Digital Post to e-boks
  • To customers abroad:
    • Via e-mail

3.4. Certain Activities may be subject to specific requirements and conditions, which will be outlined in a separate agreement which the requester.

4. Right of Cancellation

4.1. You have a 14-day right of cancellation, calculated from the date on which you receive notification that VIA has completed the processing and finally accepted your registration, cf. section 1.3 above, (the “Cancellation Period”).

4.2. If you wish to exercise your right of cancellation, you must clearly and unambiguously notify VIA within the Cancellation Period, cf. section 4.1, by sending an e-mail to the administrative partner of the Activity or to studieservice@via.dk. Please remember to include the Activity Number in your notification. The Cancellation Period is considered met if your cancellation e-mail is sent before the expiry of the deadline, cf. section 4.1.

4.3. Upon timely and correct exercise of the right of withdrawal, cf. sections 4.1 and 4.2, all payments received will be refunded without undue delay. Refunds will be issued using the same method of payment as the original transaction, unless you have expressly agreed otherwise.

4.4. When you register for an Activity at VIA, you expressly consent to VIA, after final acceptance of the registration, cf. point 1.3, initiating the delivery of the services necessary for the Activity – including granting access to digital learning platforms or materials.

By accepting these terms and conditions, you acknowledge that your right of cancellation expires once VIA has initiated the delivery of the services associated with the Activity, as the Activity is then considered in use. You will receive an e-mail confirming this consent in connection with your registration.

5. Withdrawal

5.1. Withdrawal from the Activity can be done via e-mail to the administrative partner of the Activity or to studieservice@via.dk

5.2. Withdrawal with a refund of the participation fee after the application deadline and up until the Activity begins can only be granted in exceptional cases substantiated by documented extraordinary circumstances, e.g. critical illness.

5.3. Please note that withdrawal with a refund after the Activity has begun is not possible regardless of the reason. 

5.4. Your application is personal, irrespective of whether your employer covers the participation fee. Accordingly, you bear personal liability for your registration and the associated payment obligations.

5.5. Competence Fund Grants

If you have made your registration conditional on approval of competence fund grants/funds from Omstillingsfonden, you may cancel on this basis after the application deadline. Please be aware that you are not guaranteed a place in the Activity for as long as your registration remains dependent on the approval of such grants.

6. Reservation for errors, changes and cancellations

6.1. VIA reserves the right to cancel an Activity if there are an insufficient number of registered participants, or if VIA is otherwise forced to cancel the Activity, cf. also section 1.4.

6.2. VIA reserves the right to change the teacher and teaching dates for the Activity. VIA also reserves the right to correct any typographical errors. VIA reserves the right to change and update the rules and conditions applicable to participation in the Activities.

7. Rights

7.1. VIA holds full ownership of all materials used in the Activities, including but not limited to teaching materials. Therefore, the material may not be published or otherwise shared in any way without prior written consent from VIA.

8. Exams and Issuance of Certificates

8.1. You are entitled to three exam attempts within a period of two years, calculated from the month in which the first exam date was scheduled.

8.2. Certificates of participation are issued in accordance with applicable legislation.

9. Personal data

9.1. When you are admitted to a programme at VIA, VIA processes your information for study administration purposes. VIA retrieves address and name information from the CPR register. On via.dk you can find VIA's privacy policy, where you can read about the rules governing our data processing.

10. Complaints and Liability

In the event of dissatisfaction with any aspect of your education programme at VIA, you may contact VIA at studieservice@via.dk. Complaints must be submitted within a reasonable time after you have become aware of any deficient conditions.

VIA is not liable for failure to fulfil its obligations, delays, or interruptions if the delay, interruption, or failure is due to force majeure or extraordinary circumstances that VIA could not reasonably be expected to have considered or foreseen when concluding the agreement.
